By accessing or using the AssessPro platform ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, do not use the Service.
AssessPro provides a web-based talent intelligence platform combining psychometric assessments and applicant tracking tools. The Service is intended for use by employers, recruiters, and HR professionals to assist in their hiring processes.
AssessPro provides tools and scored reports to inform your decision-making. We do not make or recommend hiring decisions on your behalf. All employment decisions remain solely your responsibility.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for unlawful purposes.

You are responsible for obtaining any consents required under applicable law before inviting candidates to complete assessments. AssessPro provides the mechanism for consent collection but you remain the data controller for candidate data held in your account.
Assessment scores, reports, and narratives are generated algorithmically and are intended to supplement, not replace, human judgment. You acknowledge that no assessment tool is perfectly predictive of job performance and that results should be considered alongside other evaluation methods.
Access to certain features requires credits purchased through the Service. Credits are:
All credit purchases are final. Consumed credits are non-refundable. Unused credits do not expire.
We reserve the right to change credit pricing with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
All content, assessments, scoring algorithms, reports, and software comprising the Service are the exclusive property of AssessPro and its licensors. Nothing in these Terms grants you any ownership rights in the Service or its underlying intellectual property.
You retain ownership of the candidate and organizational data you input into the Service. By using the Service you grant AssessPro a limited licence to process that data solely to provide and improve the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We handle personal data in accordance with applicable Canadian privacy legislation, including PIPEDA.
To the maximum extent permitted by applicable law, AssessPro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:
In no event shall AssessPro's total liability to you exceed the amount you paid for the Service in the twelve months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that assessment results will meet any specific standard of accuracy or predictive validity for your particular use case.
You agree to indemnify and hold harmless AssessPro and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party right.
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with an updated date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
